In fact, it is Palm that is in breach of the USB licence, by using Apple’s Vendor ID to trick iTunes into thinking that the Pre is an iPod.

“Palm may only use the single Vendor ID issued to Palm for Palm’s usage,” the letter says. “Usage of any other company’s Vendor ID is specifically precluded. Palm’s expressed intent to use Apple’s VID appears to violate the attached policy.”

It was always fairly obvious that the only way Palm could be tricking iTunes was to use Apple's Vendor Code, which is in breach of contract to the USB-IF.

It was also fairly obvious that Apple were probably using a blacklist of IDs which Palm were trying to use, or the Pre was responding in a way that Apple devices don't.

Given that they could have used iSync on the Apple or any other media player on Windows, I really don't understand what all the fuss is about...

Why must they synchronise with iTunes?

Probably because iTunes is the dominant music player on Windows and Macs. If people are all using iTunes people will not want to duplicate their music collection to use another phone. Pal could have their own app that scans for every track and just link to it. Obviously tracks with DRM will not be useable but most people have few DRM tracks anyway so it really should not affect the majority of tracks.

MarkSpace does a suite of apps for various devices.

Oh, look: Palm Pre syncing with iTunes. If these guys can do it, then why the hell can’t Palm do it? Looks like Palm were trying to prove a point, and messed up.
